Payments, Refunds, & Cancellations
Mark Media 404 Ltd acts as an intermediary between Service Providers (known as 404's) and Customers. All payments for goods and/or services made via Mark Media 404 Ltd are subject to such Policies and Terms as published by the company.
Please note that additional Terms not included in Mark Media 404 Ltd.'s published documents may be included by Service Providers in their product listings and/or contracts. Please refer to your order documentation for more details.
Payments
Payment for all Goods and/or Services is required prior to the fulfilment of any Order. Credit Terms are not offered unless by express written permission of Mark Media 404 Ltd.
All service users are required to report duplicated or incorrect payments to Mark Media 404 Ltd within 24 hours, and return any overpaid funds immediately. Mark Media 404 Ltd retains the right to recover any payment issued in error.
Refunds
In the event of a customer refund request, Mark Media 404 Ltd will abide by any and all statutory legal obligations, as well as contact the relevant provider of any goods and/or services to investigate the matter. Mark Media 404 Ltd accepts no liability for losses or damages incurred as a result of the lack of timely engagement from any party.
In the event of any financial losses to any party due to fraudulent activity by either Customer(s) or any service provider, Mark Media 404 Ltd will undertake to assist the relevant party in debt recovery action, as well as report to, and cooperate with, law enforcement agencies.
Cancellations
Mark Media 404 Ltd and it's Service Providers abide by all statutory rights for cancellations, in accordance with UK law.
Once an order has been submitted, it can be cancelled by a Customer or Service Provider with no penalty, prior to said order being accepted by a Service Provider.
Customer Cancellations
In the event that an Order has been Accepted by a Service Provider, but not yet Fulfilled, may still be cancelled, subject to a cancellation fee.
The purpose of such fees are only to fairly compensate the Service Providers (including Mark Media 404 Ltd) for costs incurred due to time, materials and labour spent in relation to the order. The amount of compensation payable will be fairly calculated at the sole discretion of Mark Media 404 Ltd on a case-by-case basis, but may not exceed the total value of the submitted Order(s). Compensation owed in this way may be deducted from future or pending payments, and/or repayments/refunds, to the relevant party.
Cancellations by Service Providers (404's)
In the event that an Order has been Accepted by a Service Provider, but cannot be fulfilled, the Customer will receive a full refund in a timely manner. The total value of any refund will not exceed the value of the original Order(s).
Compensation for losses and/or damages as a result of an unfulfilled or cancelled order cannot be offered by Mark Media 404 Ltd under any circumstances.
Disclaimers
Any Order(s) that have been submitted by a customer, accepted by a service provider, and not cancelled in accordance with the published Cancellation Policy, may require the cancelling party to compensate Mark Media 404 Ltd for losses and/or damages incurred. The amount of compensation payable will be fairly calculated at the sole discretion of Mark Media 404 Ltd, on a case-by-case basis, but may not exceed the total value of the original Order(s). Compensation owed in this way may be deducted from future or pending payments, and/or repayments, to the relevant party.
This notice is published as part of a suite of documents governing the use of Mark Media 404 Ltd.'s services, known as 'The Terms' in the event of contradiction or confusion, either in whole, or in part, with any other published statement, policy or missive, Mark Media 404 Ltd reserves the right to implement whichever declaration best fits the companies own best interests at any given time.
